Food Truck Finder ("the Platform", "we", "us") is a digital marketplace operated in Australia that connects customers with independent food truck vendors.

The Platform allows:

• Customers to discover and browse food truck listings for free
• Food truck vendors to create paid subscription listings to promote their businesses

By accessing or using the Platform, you agree to be bound by these Terms & Conditions.

• "Platform" refers to the Food Truck Finder website and mobile application
• "Customer" refers to any person browsing or using the Platform to find food trucks
• "Vendor" refers to a food truck owner or operator with a paid subscription
• "Subscription" refers to the paid vendor listing service with monthly billing
• "Content" refers to business information, menus, photos, and other data uploaded by vendors

The Platform is a listing and discovery service only.

The Platform:

• Does NOT prepare, sell, deliver, or handle food
• Does NOT control vendor operations, pricing, or service quality
• Does NOT act as an agent, employee, or representative of vendors
• Is NOT responsible for food quality, safety, hygiene, or customer service
• Does NOT process orders or payments between customers and vendors

Vendors are independent businesses. All transactions, interactions, and disputes occur directly between customers and vendors. The Platform facilitates discovery only.

Vendors are solely responsible for:

• Accuracy: All business information, menus, pricing, and opening hours must be accurate and up to date
• Compliance: All food safety regulations, health codes, and licensing requirements under Australian law
• Permits & Insurance: Obtaining and maintaining all necessary permits, licenses, and insurance coverage
• Food Safety: Ensuring all food preparation, storage, and handling meets Australian food safety standards
• Customer Service: Handling customer inquiries, complaints, and disputes directly
• Pricing: Setting and honouring prices displayed on the Platform
• Content: Ensuring uploaded content (photos, descriptions) is accurate, legal, and not misleading

Vendors acknowledge that failure to maintain accurate information or comply with legal requirements may result in account suspension or termination without refund.

5.1 Subscription Plans

Vendors can choose from Pro ($39/month) or Premium ($59/month) subscription plans. All prices include GST as required by Australian law. All new subscriptions include a 30-day free trial period.

5.2 Billing

• Subscriptions are billed monthly in advance
• Billing occurs on the same calendar date each month
• Automatic renewal unless cancelled by the vendor
• Failed payments result in a 3-day grace period before listing suspension

5.3 Cancellation

• Vendors may cancel subscriptions at any time via the dashboard
• Listings remain active until the end of the paid billing period
• No refunds for partial billing periods unless required by Australian Consumer Law
• Cancelled accounts may be reactivated by subscribing again

5.4 Price Changes

We reserve the right to change subscription pricing with 30 days' notice to current subscribers. Existing subscribers will be charged the new price from their next billing cycle.

Users must NOT:

• Post false, misleading, or inaccurate information
• Upload offensive, illegal, or inappropriate content
• Violate intellectual property rights of others
• Impersonate other businesses or individuals
• Attempt to manipulate rankings or reviews
• Use the Platform for spam, phishing, or malicious purposes
• Interfere with Platform functionality or security
• Scrape or harvest data from the Platform

Violations may result in immediate account suspension or termination without notice or refund.

7.1 By Vendor

Vendors may terminate their account at any time. Listing will remain active until the end of the current billing period. No refunds will be issued.

7.2 By Platform

We may suspend or terminate accounts immediately if:

• Terms are breached
• Platform is misused or abused
• Legal or regulatory concerns arise
• Payment is repeatedly declined
• False information is provided

Terminated accounts do not receive refunds for the current billing period.

To the maximum extent permitted by Australian law:

• The Platform is provided "as is" without warranties of any kind
• We are NOT liable for vendor actions, food quality, or customer service issues
• We are NOT liable for food-related illness, injury, or damages
• We are NOT liable for business losses, revenue loss, or opportunity costs
• Our total liability is limited to the subscription fees paid in the 3 months prior to the claim

Where Australian Consumer Law applies, our liability is limited to resupplying services or refunding subscription fees where legally required.

Nothing in these terms excludes or limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any other liability that cannot be excluded under Australian law

The Australian Consumer Law (ACL) provides consumers with certain guarantees that cannot be excluded.

Your rights under the ACL are not affected by these terms.

For vendor subscription services, ACL guarantees include:

• Services provided with due care and skill
• Services fit for purpose
• Services completed within reasonable time

Important: Food truck vendors are independent businesses. Consumer guarantees regarding food quality and service apply between the customer and the vendor directly, not the Platform.

10.1 Platform IP

All Platform content, design, code, and branding remain our intellectual property. Users may not copy, modify, or distribute Platform materials without permission.

10.2 Vendor Content

Vendors retain ownership of uploaded content (photos, menus, descriptions). By uploading, vendors grant us a non-exclusive license to display and distribute content on the Platform.

Vendors warrant that they have the right to upload all content and that content does not infringe third-party intellectual property rights.

Your use of the Platform is subject to our Privacy Policy, which complies with the Australian Privacy Act 1988 and Australian Privacy Principles.

We may update these terms from time to time. Changes will be posted on this page with an updated "Last Updated" date.

Continued use of the Platform after changes constitutes acceptance of the revised terms. Significant changes will be communicated via email to registered users.

These terms are governed by the laws of New South Wales, Australia.

Any disputes arising from these terms or use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
